1. Who we are and accepting these terms

swiftyquote.com and demo.swiftyquote.com (the Site) are operated by Instrusolve LLC (a Wyoming limited liability company) (we, us, our), with its business and mailing address at 30 N Gould St Ste R, Sheridan, WY 82801, USA. SwiftyQuote is a product of Instrusolve LLC.

We may use affiliates and subcontractors to provide our services, and we remain responsible for their work.

By using the Site, you agree to these Terms of Use. If you use the Site on behalf of a company, you confirm you have authority to accept these Terms for it. If you do not agree, please do not use the Site.

2. What the Site is

The Site describes our service: we build product configurators for instrumentation manufacturers and suppliers worldwide, as a one-time build, with no subscription. It includes marketing content, a blog, forms to request a free sample or contact us, and demo configurators.

The Site is for general information only. Nothing on it is professional, engineering or legal advice. The Site is intended for business users.

3. Demo configurators

Some demos are based on products made by other companies. For all demos:

  • Unofficial. They are independent demonstrations built by us to show our service. They are not official tools of any manufacturer. Unless a demo clearly says otherwise, we are not affiliated with, authorised, sponsored or endorsed by the manufacturer, its affiliates or its distributors.
  • Trademarks. Manufacturer names, product names and other marks belong to their owners. We use them only to identify the products a demo is based on.
  • Illustrative only. Product data comes from publicly available information and may be incomplete, out of date or wrong. Photos and images are shown for demonstration only. Ordering codes, specifications and prices (if any) are examples.
  • Not for ordering. A demo does not give you a quotation, offer or order from us or the manufacturer. Before you buy or specify anything, confirm model codes, specifications, approvals and suitability for your application, including suitability for any hazardous area, directly with the manufacturer or its authorised representative.
  • Where requests go. The demos do not transmit your entries themselves. If you click a demo's "Send request" button, your own email program opens a pre-filled email addressed to us (sales@swiftyquote.com), not to the manufacturer. Nothing is sent unless you send that email. We do not pass demo requests to the manufacturer.

4. Requests and quotes do not create a contract

Submitting a demo request, sample request, contact form or quote request does not create a contract between you and us, and does not oblige either of us to do anything. Any quote or proposal we send is an invitation to discuss, unless it says otherwise in writing.

Paid configurator builds are governed only by a separate written client service agreement between you and Instrusolve LLC. If that agreement conflicts with these Terms, the agreement wins for that work.

5. Acceptable use

You must not:

  • scrape, crawl, harvest or copy the Site, the demos or their data by automated means, except normal search-engine indexing;
  • copy, decompile, reverse engineer or rebuild our configurators, code or design, except as the law expressly allows despite this restriction;
  • use the Site or demos to build a competing product or service;
  • submit false, misleading or other people's details, spam, or automated submissions through our forms;
  • try to access parts of the Site or our systems you are not authorised to, interfere with security, or introduce malware;
  • use the Site unlawfully or in a way that infringes anyone's rights.

We may block access or remove content if we reasonably believe these Terms have been breached.

6. Intellectual property

The Site's own content, including text, design, layout, software, code and the configurator logic we built, belongs to us or our licensors. You may view and print pages for your own internal evaluation of our services. Any other use needs our written permission.

Third-party names, marks, logos, product data, photos and documents shown on the Site belong to their respective owners. Nothing on the Site gives you any right to use them.

7. Takedown requests and complaints

If you own rights in anything shown on the Site (for example, you are a manufacturer whose product is featured in a demo) and want it changed or removed, or you have any other complaint, email sales@swiftyquote.com with:

  • who you are and what rights you hold;
  • the page(s) or content concerned; and
  • what you would like us to do.

We will review it promptly and, where appropriate, change or remove the content.

8. Privacy

Our Privacy Policy explains how we collect and use personal data, including details you enter in our forms and demos.

9. Disclaimer of warranties

THE SITE AND ALL DEMOS AND CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR ANY DEMO DATA IS ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED OR FREE OF ERRORS OR VIRUSES. YOU ARE RESPONSIBLE FOR CHECKING ANY INFORMATION BEFORE RELYING ON IT.

10. Limitation of liability

10.1 What we never limit. NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. IF YOU ARE A CONSUMER, YOU KEEP ANY MANDATORY RIGHTS UNDER THE LAWS OF THE PLACE WHERE YOU LIVE.

10.2 Limits. SUBJECT TO SECTION 10.1, AND TO THE FULLEST EXTENT PERMITTED BY LAW:

(a) WE ARE NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR RELIANCE ON DEMO CONTENT, INCLUDING THE SELECTION, SPECIFICATION, ORDERING OR INSTALLATION OF ANY PRODUCT, EVEN IF THE LOSS IS CAUSED IN WHOLE OR IN PART BY OUR OWN NEGLIGENCE, BECAUSE DEMOS ARE ILLUSTRATIVE ONLY AND NOT FOR ORDERING (SEE SECTION 3);

(b) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFIT, REVENUE, BUSINESS, DATA OR GOODWILL, HOWEVER CAUSED, INCLUDING BY OUR OWN NEGLIGENCE; AND

(c) OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE OR THESE TERMS, INCLUDING CLAIMS BASED ON OUR OWN NEGLIGENCE, IS LIMITED TO THE GREATER OF (i) USD 100 AND (ii) THE AMOUNTS YOU PAID US FOR USE OF THE SITE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

10.3 These limits apply to use of the Site only. Liability for paid work is set out in the client service agreement.

11. Indemnity

If you breach section 5 (Acceptable use) or use the Site unlawfully, you agree to cover our reasonable losses and costs (including reasonable attorneys' fees) arising directly from that breach. This does not apply to the extent the loss was caused by our own negligence or misconduct.

12. Third-party links

The Site links to third-party websites, such as manufacturers' product pages and datasheets. We do not control them and are not responsible for their content, accuracy or availability. A link does not mean we endorse the site or are endorsed by it.

13. Changes

We may update these Terms from time to time. The updated version takes effect when posted on this page, and the "Last updated" date will change. If you keep using the Site after that, you accept the updated Terms.

14. General

If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. These Terms are the whole agreement between you and us about using the Site. A separate client service agreement covers paid work.

15. Governing law and courts

These Terms, and any dispute arising from them or from your use of the Site, are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. The state courts located in Sheridan County, Wyoming, and the United States District Court for the District of Wyoming, have exclusive jurisdiction, and you and we consent to their jurisdiction and venue.

If you are a consumer in the EU, EEA or UK (or another country whose law gives you this right), this choice of law does not deprive you of the protection of the mandatory laws of your country of residence, and you may also bring proceedings in the courts of your country of residence.
